General Average: Procedure, security, defences (Part 2 of 3)

In the 2nd session of 3 Ben Browne (a partner at Thomas Cooper LLP, chairman of the London Admiralty Solicitors Group, IUMI’s representative during the negotiations which led to the YAR 2004 and 2016 and on the Committee monitoring the new YAR Guidelines) explained some of the practical issues surrounding the declaration, obtaining security for and defences against claims for GA such as:

  • When GA can be declared.
  • Who pays GA?
  • The Average Adjuster’s role.
  • Jurisdiction and enforcement.
  • Cargo defences to General Average claims (unseaworthiness and other such defences).
