General Average: The York-Antwerp Rules 2016 (Part 3 of 3)

In May 2016 the Comité Maritime International (CMI) approved a new set of York-Antwerp Rules (“YAR”). The YAR 2016 had been approved by BIMCO for inclusion in their standard forms of contract of carriage and should start appearing in contracts in late 2016. The YAR govern the way in which General Average (“GA”) allowances are made and the YAR 2016 make a number of important changes to the YAR regime.

In this Webinar series, consisting of 3 sessions Ben Browne (a partner of Thomas Cooper LLP, chairman of the Admiralty Solicitors Group, IUMI’s representative during the negotiations which led to the YAR 2004 and 2016 and on the Committee monitoring the new YAR Guidelines) described the YAR 2016 focussing especially on the changes to the YAR 1994 and 2004. The 3rd Session covered:

·       The background and context of the YAR 2016;

·       The main areas of change made by the YAR 2016 (such as salvage, contributory values, temporary repairs to the ship, treatment of low value cargo, interest and commission etc.); and

·       The introduction of the YAR Guidelines
